
On 15 February 1864, E. H. Gatlin was promoted to the rank of Captain by Special Orders No. 9 issued by the Head Quarters of Posey's Brigade. This order is reproduced at the left and reads as follows:

I. There being a vacancy in the Office of Captain Co. "A" 16th Miss regiment caused by the resignation of Capt.W. G. Collins on the 19th Day of December 1863, it is hereby ordered that 1st Lieut E. H. Gatlin of said company be promoted (his competency not being questioned) to fill said vacancy to take rank as Captain of said Company from the 19th Day of December 1863, subject to the approval of the President.
II. There being a vacancy in the Office of 1st Lieut. Co. "A" 16th Miss regiment caused by the promotion of Lieut E. H. Gatlin the 19th Day of December 1863, it is hereby ordered that 2nd Lieut F. J. Casey of said company be promoted (his competency not being questioned) to fill said vacancy to take rank as 1st Lieut of said Company from the 19th Day of December 1863, subject to the approval of the President.

[Note: Although still referred to as Posey's Brigade, the Brigade at this time was under the command of Col. N. A. Harris. Carnot Posey had died the previous November of wounds received at the battle of Bristoe Station. The Posey signature on the order was that of one of Carnot Posey's sons who was attached to the Brigade staff as adjutant.]
